Rationalisation of Death Gratuity by 7th Pay Commission

The Commission has received representations pointing to a need for rationalization of current slabs for death gratuity, especially for the slab of 5 to 20 years of qualifying service in which family pensioners are stated to be placed at a disadvantageous position.

Analysis and Recommendations : As per Rule 50 of Pension Rules, the death gratuity admissible will be as follows, subject to the maximum limit prescribed for the gratuity:

    through its order dated 20 April 1982 established Fish Farmer Development Agencies registered in Societies Registration Act, 1860 in 17 districts separately & sanctioned 11 posts with around 19 vacancies in each agency. N the above 19 sanctioned vacancies, agency employed 19 persons in agency of district Lucknow, whose nature are as under :
    1. 4 employees recruited by agency directly through employment exchange. 2.15 employees recruited by agency on deputation from state’s fishries department. Red Now above 4 employee recruited by agency are retiring on superannuation. Kindly tell whether above 4 employee are entitled to gratuity or not, if yes then which gratuity , please code Order. (Covered under government gratuity rule or covered by payment of gratuity act 1972)
